In short (not part of the policy)
- Use the Software and our services lawfully, honestly and within your License.
- Use marketplace buyers' details only for their orders and your legal duties; no marketing unless they agreed and the marketplace allows it.
- Don't attack our services or get around License Checks, Seats or other limits. Keep keys private and the office server off the internet. No AI Assistant decisions about people.
- Report security problems to support@livingroomlogistics.com, abuse to support@livingroomlogistics.com. We usually warn first; a refused License Key makes the Software read-only. We never delete your data when a License ends or its key is refused.
LivingRoom Acceptable Use Policy Draft 2 of 2026-10-25 - not yet in effect
This Acceptable Use Policy ("Policy") is published by Point of the Mountain Software LLC, a Utah limited liability company ("Company", "we", "us", "our"), for its LivingRoom software ("Software"). It is part of our Terms of Service and of our End User License Agreement ("EULA"). Words with capital letters have the meaning given in the EULA and the Terms of Service, unless section 1.2 defines them.
1. Who this Policy applies to
1.1 This Policy applies to everyone who uses the Services or contacts our support ("you"): Customers and their Authorized Users (including clients' staff, EULA section 2.3), for whom the Customer is responsible and to whom it makes this Policy known; Resellers and their staff, whose Reseller Agreement also applies and wins where the two differ; and anyone else, such as someone asking for a Trial.
1.2 Online Services means the Website, the License Server, the Reseller Portal and any other online service we run for the Software (such as a connection service or the AI Assistant's online add-on, once switched on). Services means the Software, the Documentation, the Online Services and our support, Support Sessions included.
1.3 This Policy gives examples, not a complete list of misuse. If it conflicts with the EULA, the Terms of Service, the Beta, Coming Soon and AI Assistant Terms ("Beta and AI Terms"), our Data Processing Addendum where it applies, or an agreement you signed with us, that document wins.
1.4 This Policy does not take away any right that the law gives you and that a contract cannot exclude.
2. Unlawful, fraudulent and deceptive use
You will not use the Services: (a) to break, or help anyone break, a law that applies to you or us; (b) to buy, sell, store, track or ship goods that are illegal, counterfeit or stolen or that you may not lawfully sell; (c) to keep or produce false records meant to mislead; (d) for fraud, such as false refund or chargeback claims, untrue New Business applications or Trials under other names; (e) to impersonate anyone, imply our endorsement, or trick people into giving you a License Key, a password, a Support Fingerprint or other access details; or (f) to harass, threaten, defame or harm anyone.
3. Spam
3.1 The Software sends e-mail only through the Customer's own e-mail server and is not designed for bulk or marketing e-mail.
3.2 Do not use the Services to send bulk or unsolicited commercial messages, or messages that hide or fake their sender. How you market to your own customers and contacts outside the Services is up to you, within the law and section 4.4 for marketplace buyers.
3.3 Commercial e-mail you send with them must comply with the anti-spam laws that apply, such as the US CAN-SPAM Act (which covers e-mail to businesses too).
3.4 Do not send unsolicited messages that name us or the Software or link to our Website or a Paddle checkout for it. Resellers: section 11.
4. Other people's rights and personal data
4.1 Import only data you have the right to use, not data copied from someone else's seller account, collected against a marketplace's terms or obtained unlawfully.
4.2 Do not use the Services to infringe anyone's intellectual property, privacy or publicity rights.
4.3 You are responsible for the personal data in Customer Data (EULA section 8.7): keep only what you need, keep it secure and answer requests from the people it is about.
4.4 Marketplace buyers. For buyers' personal data from a marketplace or other Third-Party Service, you will: (a) use it only to fulfil, ship and service their orders (returns, refunds and customer service included) and for your legal, tax and accounting duties; (b) not use it for marketing, newsletters, offers or review requests unless the buyer agreed and the marketplace allows it (some allow none outside their own services, even with consent); (c) not sell or rent it, disclose it beyond (a) or combine it with other data to profile buyers; (d) keep it only as long as the marketplace's rules and the law allow, and delete it when they require; and (e) follow each marketplace's own rules on it, which apply where stricter than this Policy. The Software cannot yet delete one buyer's details [not yet available]; you can delete the kept copies of imported files and empty a Company File (EULA section 8.8). Until the Software can delete one buyer's details, we will not act under section 14 because such details remain in the Software, as long as you use them only as (a) allows.
4.5 Payment and ID numbers. Do not put payment card numbers, online-banking passwords or access codes, or individuals' Social Security, passport or driver-license numbers into the Software, notes and attachments included; it is not designed to protect them (attachments and kept copies of imported files are not encrypted, EULA section 8.5). Business details, such as a supplier's bank account on its invoice, a business tax ID (EIN) or a sales-tax exemption certificate number, may be kept.
4.6 Keep your Third-Party Services' API keys and passwords confidential; do not share them or use anyone else's (EULA section 9.2).
5. Security of our Online Services
5.1 Without our written permission you will not: (a) look for weaknesses in an Online Service or get around its sign-in, security or limits; (b) load- or stress-test, attack or overload it; (c) scrape, crawl or bulk-copy the Website or the Reseller Portal or use bots or scripts on them (ordinary search-engine indexing of public Website pages excepted); (d) access or try to access accounts or data that are not yours; (e) send or upload malware or anything meant to damage, disrupt or take over a system; (f) call the License Server except through the Software as we release it, or block, change or fake its answers; or (g) intercept or tamper with the Software's connection to an Online Service.
5.2 Your own Installation. You may test the security of your own Installation on your own PCs and network if you do not reverse engineer the Software beyond section 8.1 or touch an Online Service or anyone else's systems, and you report what you find to us (section 13). [to be confirmed]
5.3 Limits. A request over a limit is refused for a while. The main limits at the date of this Policy:
| Where | Limit |
|---|---|
| Software sign-in | 10 failures in 15 minutes per user name or network address (phones: 10 per address, 30 per user): refused for up to 15 minutes |
| Reporting API | Read-only; at most 5,000 rows per request (1,000 by default); 20 seconds per query |
| Reporting API and web companion keys | 10 failed keys a minute per address: refused for up to a minute |
| Manage subscription, Change plan [not yet available] | 20 requests an hour per License Key |
| Reseller Portal [not yet available] | About 10 sign-in or password attempts and 120 requests a minute per address; 5 failed sign-ins in a row lock the account for 15 minutes, up to 24 hours if repeated (reassigning keys: Reseller Agreement section 6.2) |
We may change, add or lift limits; they are not a promise of capacity. Do not get around one, for example by spreading requests over several addresses or accounts.
6. License limits and technical protections
6.1 You will not get around, disable or tamper with License Keys, License Checks, Seats, the Company Files limit, the number of PCs a License Key allows (one for a key bought online or from a Reseller, EULA section 4.6), the Grace Period, Read-Only Mode, Override Codes, Support Tokens, signature or integrity checks (of License Keys, License Server answers, Updates or AI Model files) or any other technical limit or protection (EULA section 3(c)), for example by (a) changing the PC's clock or editing the Software's databases, settings or files, (b) changing, copying or faking a Machine ID, or (c) modifying or patching the Software. Do not remove or change the "Beta", "Coming soon" or AI labels or other notices (EULA section 3(g)).
6.2 One person, one User Account. Each Authorized User signs in with their own User Account; do not share one to use fewer Seats.
6.3 Do not create, copy, forge or change a License Key, Override Code or Support Token, or use one issued for another business, PC, License Key or Installation.
6.4 Do not try to sign in with our support account, or write down, keep or reuse a Support Token seen during a Support Session. [to be confirmed]
6.5 Do not ask for more than one Trial per business unless we agree (Terms of Service section 4.1).
6.6 Do not offer the Software to other businesses as a hosted, time-sharing or service-bureau service, except to keep your own clients' records (EULA section 2.3).
7. License Keys
7.1 Keep your License Key private, like a password: by default it also opens your Backups (EULA section 8.4).
7.2 Do not share, publish, give away, sell, rent or transfer a License Key or use it beyond its limits, except with your Authorized Users and the contractors and advisers who need it to install, restore or support the Software for you (who must keep it confidential), with the sale of your business (EULA section 16.3) or as a Reseller assigning keys to its customers through the Reseller Portal under its Reseller Agreement (EULA section 3(b)).
7.3 Only a Reseller may resell License Keys, and nobody may offer them on marketplaces, auction or key-reselling sites. A License Key obtained from anyone but us or a Reseller may be refused.
7.4 If a License Key has been exposed, tell us at once at support@livingroomlogistics.com so that we can help you replace it.
8. Reverse engineering, competing products and AI training
8.1 You will not reverse engineer, decompile or disassemble the Software except as EULA section 3(d) allows; for interoperability information, ask us first.
8.2 You will not use the Services to build or improve a product that competes with the Software, or to train, fine-tune or test an AI model meant to copy or compete with it (EULA section 3(i)).
8.3 Your data stays yours. Section 8.2 does not limit your own use of Customer Data, reports, exports and Outputs about it included, within the terms of the Third-Party Services whose data it contains (EULA section 3(i)).
9. The AI Assistant
9.1 The AI Assistant is a Coming Soon Feature in the current release: it is not available and is not part of what any Plan pays for. When we publish its model on our own download host (Cloudflare R2, under our account), it becomes a Beta Feature included in every Plan. [to be confirmed] Beta and AI Terms section C7 sets the rules for its use. In short, you will not use it: (a) for anything unlawful, fraudulent, deceptive, harassing or harmful; (b) to profile, categorise or make automated decisions about people, or to make or support decisions with legal or similarly significant effects on a person (such as on employment, credit, housing, insurance or access to services); (c) to try to make it ignore its instructions, permissions or limits, reach data the asking user may not see, or extract, copy or reconstruct the AI Model or the Software; (d) with Marketplace Data that a provider's terms do not allow you to use with an AI system; or (e) to present Outputs as professional advice or human-written where that would mislead, or the AI Assistant as a person.
9.2 Each AI Model's own license also applies (Beta and AI Terms section C9). Report an offensive, infringing or harmful Output to support@livingroomlogistics.com (section C10).
10. The office server, phones and access keys
10.1 Your own network. Office Server Mode and the phone pages are for your own network: do not make the office server PC, its port, the phone pages, the Reporting API or the web companion reachable from the internet (for example by port forwarding or a public tunnelling service). To work from outside the office, use a virtual private network (VPN) that you control and only your Authorized Users can join.
10.2 Access keys. The Reporting API and web companion keys give read access to Customer Data without a sign-in or a Seat (EULA section 7.3). Treat them like passwords: give them only to people who should have that access, keep them only in tools you control, and never put them in shared documents, code repositories or messages to outsiders. Give the office connection code only to your own business's PCs.
10.3 Revoke or replace a key when someone who had it leaves or it may have been exposed.
10.4 These keys are for your own analysis tools, not a way to give people who are not Authorized Users ongoing access to Customer Data.
11. Resellers
11.1 A Reseller markets and sells only as its Reseller Agreement (sections 6, 10 and 11) and our Reseller Trademark and Advertising Rules allow, and under the anti-spam and telemarketing laws that apply to it.
11.2 Reseller Portal. Keep your password, authenticator and recovery codes secret, do not share your account or use scripts or scraping tools on the Portal, and enter only customer details you may give us (Reseller Agreement section 5.4).
12. Sanctions and export
12.1 The Services are subject to US export control and sanctions laws (EULA section 18). You will not use, download, access, buy or resell them, or let anyone else do so: in, or for anyone located or ordinarily resident in, a country or region under a comprehensive US embargo; by or for anyone on a US government restricted-party list or owned 50 % or more by such a party; or for a use those laws prohibit.
12.2 Do not hide your location or identity (for example through a proxy or a VPN, or by buying through someone else) to get around these laws or the countries Paddle's checkout refuses.
12.3 A breach of this section cannot be put right: we may refuse a License Key, a License Check, an Update or support at once (EULA section 18.3).
13. Reporting a security problem or abuse
13.1 Security problems. Report a suspected vulnerability in the Software or an Online Service to support@livingroomlogistics.com [not yet available], with how to reproduce it and how to reach you. Keep it confidential until we have had a reasonable time to fix it, and send no more personal data than needed. [to be confirmed]
13.2 Abuse. Report other misuse of the Services to support@livingroomlogistics.com.
13.3 What we can do. We hold no copy of Customer Data and, outside a Support Session a Customer arranges with us, cannot see, change or delete it. If a business misuses your personal data or rights through the Software, we can act only on its License (section 14); please also contact that business and the marketplace concerned.
13.4 We answer reports as our Support Policy describes and may not be able to tell you what we did about someone else's account.
14. What we may do
14.1 How we learn of a breach. We do not monitor your use of the Software; we act on reports, our Online Services' records and information from Paddle, a marketplace or an authority. What we see in a Support Session we use only for the support you asked for, except where the law requires us to disclose it (EULA section 10.5).
14.2 Our steps. If we reasonably believe this Policy has been broken, we may, as the case requires: (a) ask for information or warn you; (b) decline or stop support, Support Sessions, a Trial or a New Business discount, or ask Paddle to decline a new Order; (c) disable a Reseller Portal account (Reseller Agreement section 3.3); (d) block network addresses or accounts from an Online Service; (e) refuse a License Key at its next License Check, putting the Software in Read-Only Mode; (f) end the License or the Reseller Agreement under its terms (EULA section 16.2, Terms of Service section 15, Reseller Agreement section 17.3); and (g) answer an authority's lawful request, or tell a marketplace or Paddle where the law or our own agreement with it requires; in each case only what is required and, unless the law forbids it or telling you first would defeat the purpose (section 14.4), after telling you and giving you a reasonable chance to respond.
14.3 Proportionate, with notice. We choose the step that fits how serious, deliberate, repeated and harmful the breach is. Where a breach can be put right, we normally warn you first and give you 15 days to put it right (EULA section 16.2, Terms of Service section 15.1). We act at once only where needed to stop serious harm to people, the Services or other customers, a security risk or fraud; where the law, a court or our agreement with Paddle or a marketplace requires it; or for a published or sold License Key or a breach of section 12.
14.4 Telling you. We send a warning, and a notice of what we did and why, by e-mail to the address on your License or Order (or on your Reseller account), and may also show it in the Software. We act without telling you first only where the law forbids it or telling you first would defeat the purpose (as during an attack); we then tell you afterwards unless the law forbids it. Reply to support@livingroomlogistics.com to explain or ask us to reconsider, and we will review our decision.
14.5 Authorized Users. For an Authorized User's breach we normally ask the Customer to deal with it before we act on its License.
14.6 What a refused License Key means.
- We never delete your data when we refuse a License Key: the Software switches to Read-Only Mode (EULA section 6).
- A License Key checked online is refused at the next License Check that reaches our License Server, normally at start-up or within about 24 hours. If the Software cannot reach our License Server, it keeps working for up to 30 days after the last successful License Check (a reminder appears after 7 days), unless your License Key expires first: a Monthly key is valid for the paid month plus 5 days, then a 14-day Grace Period (EULA sections 4.5 and 5.5). Then it switches to Read-Only Mode.
- A License Key not checked online (for example a Trial Key) cannot be refused at a License Check: it works until its expiry date, if it has one, and we may decline to issue another. [to be confirmed]
- At the date of this Policy a refused License Key cannot be switched back on and an Override Code does not work for it; to restore access (for example after a refusal by mistake, EULA section 4.8) we issue a new License Key. [to be confirmed]
14.7 Fees. We ask Paddle to refund Fees only as our Refund Policy, the Terms of Service and the law provide. The refund of the unused part of a prepaid period (EULA section 16.5, Terms of Service section 15.2) is for a License we end for another reason, not for a breach of this Policy.
14.8 Not acting on a breach does not waive our right to act on it or a later one. We are not responsible for how others use the Services.
15. Changes to this Policy
We may update this Policy and publish each version on https://livingroomlogistics.com with its effective date. If a change adds a restriction that materially affects how you use the Services, we e-mail active Customers and Resellers at least 30 days before it takes effect, unless the law, a Third-Party Service or a security risk requires it sooner. The version in force when something happens applies to it.
